EC Cosmetics Regulation 1223/2009 – Explanations and comments

A milestone in the harmonisation of the EU-wide cosmetics legislation: The new European Cosmetics Regulation (EC) No. 1223/2009 was published in the Official Journal of the EU on 22 December 2009 (L 342/59-209). It has been fully in force since 11 July 2013 and replaces the existing EC Cosmetics Directive as well as national cosmetics legislation.

Detailed explanations on the EC Cosmetics Regulation are provided by comments of Birgit Huber, Head of the Competence Partner Beauty Care within IKW, and Dr. Gerd Mildau, cosmetics expert with the Chemical and Veterinary Investigation Office (CVUA). In this publication a public authority and an industry representative interpret the new Regulation for the first time together. These comments support hence both the manufacturers and also the German surveillance authorities in the interpretation of the new Regulation. The two authors were intensively involved in their respective capacities in the course of the legislative procedure in the deliberations on the new EU Cosmetics Regulation.

Further joint publications of the two authors appeared in May and June 2013 as well as in November and December 2014 in “COSSMA”. In the form of an interview, current issues relating to the EC Cosmetics Regulation and their interpretation are discussed.

In response to many enquiries IKW also published a clarification in respect of an article published in the "Pharmazeutische Zeitung" in May 2013 which resulted repeatedly in misunderstandings concerning the interpretation of the EC Cosmetics Regulation.
